A South African Notary Public is an attorney that has studied for and passed the Notary examination with the Law Society of South Africa and is then admitted to practice as a Notary Public in the High Court of South Africa. Not every attorney is a Notary Public.
Certain documents can only be drafted and signed by, or in the presence of a Notary Public. Examples of such documents used in the Deeds office are Antenuptial Contracts, Notarial cessions, Notarial servitudes, Notarial bonds, notarial leases etc.
A Notary can also draft documents that will not be used in the Deeds office but may be used either in South Africa or overseas. Examples of such documents are: Powers of Attorney, co-habitation Agreements, declarations, documents required for emigration etc.
The office of a Notary is recognised worldwide and often countries overseas will require a document that will be used in their country but signed in South Africa to be signed in the presence of a South African Notary or documents that originate from South Africa to be notarised.
